WHAT HAPPENS AT THE ARRAIGNMENT?

After being arrested for a DUII in Oregon, you should receive paperwork from the officer or the jail (and sometimes both) that provides you with the date, time and location of your first court appearance. This first court appearance is called the arraignment. But what is an arraignment in Oregon, and what should you expect when you appear in criminal court?

What is an Arraignment in Oregon Criminal Court?

An Oregon arraignment is a court hearing where you are formally advised of the criminal charges against you and asked to enter a plea. An arraignment is an important first step in the Oregon criminal court process, but it is not a trial. The court is not deciding whether you are guilty or innocent at your arraignment.

What Happens at the Arraignment?

The exact procedure can vary depending on the court, the charges, and whether you are in custody. Having an experienced criminal defense and DUI defense attorney, such as Jacob Braunstein, who practices locally and knows the judges and prosecutors in your jurisdiction can make all the difference in your case. In general, an Oregon criminal arraignment may include:

  • Confirming the criminal charges filed against you;

  • Advising you of your right to an attorney;

  • Entering a plea, such as not guilty;

  • Addressing conditions of release, when applicable; and

  • Setting future court dates and deadlines.

In many criminal cases, a defendant enters a plea of not guilty at arraignment while the defense attorney investigates the allegations, reviews the evidence, and determines how to proceed.

Do I Have to Go to My Arraignment in Oregon?

Whether you must personally appear at an Oregon arraignment depends on several factors, including whether you are charged with a felony or misdemeanor and whether the court permits an appearance through an attorney or electronic means. In most cases, the answer is yes, you must appear for your arraignment. Oregon law contains specific rules governing appearances at arraignment. If you have received a notice to appear in court, it is important to understand the requirements of that notice rather than simply assuming that your attorney can appear for you.

Do I Need a Lawyer for an Oregon Arraignment?

You have the right to an attorney in a criminal case, and having legal advice early can be important. An experienced criminal defense attorney can explain the charges against you, advise you about your plea, address release conditions, and begin investigating the circumstances that led to your arrest or citation.
